By accessing or using MedSpa Guide ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. You must be at least 18 years of age to use MedSpa Guide.

MedSpa Guide is a free, AI-powered tool that provides cosmetic appearance guidance through live video and voice conversations. The Service analyzes your appearance in real time using artificial intelligence, suggests treatment categories that may be worth exploring with a qualified professional, and recommends nearby clinics based on treatment fit, ratings, and distance. The Service is provided on an "as is" and "as available" basis.

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. MedSpa Guide provides cosmetic appearance guidance only. The Service does not constitute medical advice, and nothing on this platform should be interpreted as a medical opinion, referral, or recommendation. We do not diagnose, treat, cure, or prevent any disease, health issue, or medical concern. The information provided is for educational and informational purposes only and is generated by artificial intelligence, which may produce inaccurate or incomplete observations. You should always consult a qualified healthcare professional before making any decisions about medical treatments, procedures, or your health. You should never delay seeking medical advice, disregard medical advice, or discontinue medical treatment because of information provided by MedSpa Guide. If our system identifies something that appears to be outside the scope of cosmetic concerns, we will recommend that you consult a healthcare professional, but this does not constitute a medical referral.

You acknowledge that: (a) the Service uses artificial intelligence that may produce inaccurate, incomplete, or misleading observations about your appearance; (b) the Service is not a substitute for professional medical evaluation or advice; (c) any decisions you make regarding treatments, providers, or clinics based on information from the Service are made at your own risk; (d) clinic recommendations are based on publicly available information and algorithmic matching, not on our endorsement of any particular provider; and (e) treatment outcomes vary by individual and are not guaranteed by any information provided through the Service.

You agree to: use MedSpa Guide for its intended purpose of cosmetic appearance guidance only; not rely on the Service as a substitute for professional medical consultation; verify any information provided by the Service with qualified professionals before acting on it; not misuse the Service, attempt to reverse-engineer our technology, or use the Service for any unlawful purpose; not use the Service on behalf of another person without their knowledge and consent; and provide accurate information about your concerns during sessions.

Clinic recommendations are generated algorithmically based on treatment fit, distance, publicly available ratings, review volume, and listing completeness. Clinics do not pay for placement or higher rankings. We do not verify the credentials, qualifications, or licensing of listed clinics or their practitioners. Clinic information is sourced from Google Places API and may not be current. You are responsible for independently verifying any clinic's credentials, licensing, and suitability before scheduling appointments or undergoing any procedures.

All content, features, and functionality of MedSpa Guide, including but not limited to text, graphics, logos, software, and AI models, are the property of MedSpa Guide and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEDSPA GUIDE AND ITS OPERATORS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. This includes, without limitation: any decisions made based on treatment suggestions, clinic recommendations, or appearance observations; any adverse outcomes from treatments or procedures you pursue based on information from the Service; reliance on clinic information that may be outdated or inaccurate; and any emotional distress related to appearance observations. Our total aggregate liability for any claim arising from your use of the Service shall not exceed CAD $100.

You agree to indemnify, defend, and hold harmless MedSpa Guide, its operators, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: your use of the Service; your violation of these Terms; any decisions you make based on information provided by the Service; or your violation of any third party's rights.

We reserve the right to suspend or terminate access to MedSpa Guide at any time, for any reason, without notice. You may stop using the Service at any time. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, assumption of risk, indemnification, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario. Before initiating any legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at hello@medspa.guide.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MedSpa Guide regarding your use of the Service and supersede any prior agreements or understandings.

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree with any changes, you should stop using the Service.
